This Acceptable Use Policy sets out the standards that apply when you access or use our website 1fit.com and the online platform available through it and its related mobile companion app (together being the ”platform”), whether you are a Coach or a Client.
It applies to any material you upload, share or post, any messages you send through the messaging feature, and any other User Content (as defined in our Terms of Use). It also applies to any contact you make with other users, any links to our site, and any other way you use our site.
This policy forms part of, and should be read together with, our Terms of Use, and words defined in those Terms of Use have the same meaning in this policy.
You must comply with these standards in spirit as well as to the letter.
We may amend this Acceptable Use Policy from time to time. It is your responsibility to ensure that you regularly review this policy and ensure that you are complying with the latest version of it.
We will determine, acting reasonably, whether any User Content or use of the platform breaches this Acceptable Use Policy.
Prohibited uses
You may not use the platform:
- in any way that breaches any local, national or international law or regulation;
- in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect;
- for the purpose of harming or attempting to harm any person in any way or to bully, insult, intimidate or humiliate any person;
- to send, knowingly receive, upload, download, share, post, use or re-use any material which does not comply with the standards set out in this policy; or
- to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
Content Standards for User Content
All User Content:
- must be accurate (where it states facts);
- must only contain opinions that are genuinely held; and
- must comply with the law applicable in any country from which it is posted and to which the post is targeted;
In no circumstances should User Content:
- be unlawful, defamatory, obscene, offensive, hateful or inflammatory;
- infringe any copyright, database right, trade mark or other rights of any person, or breach any legal duty owed to a third party (including duties of confidence);
- be threatening or abusive, invade another’s privacy, or be likely to harass, alarm, upset, embarrass or otherwise cause harm, annoyance or inconvenience to any person;
- be misleading or deceptive, including by impersonating any person, misrepresenting your identity or affiliation, or giving the impression that the content is approved or provided by us when it is not;
- advocate, promote or assist any unlawful or criminal act (including terrorism), or otherwise contain illegal content;
- include pornographic material or video content that would be likely to receive an R18 classification (or would not be suitable for BBFC classification);
- include material that may impair the physical, mental or moral development of any person;
- promote or encourage unsafe, dangerous or extreme exercise, training or nutrition practices, disordered eating, or self‑harm;
- promote, offer or facilitate the supply of illegal, controlled or prohibited substances, including anabolic steroids, other performance‑ or image‑enhancing drugs, or unlicensed medicines or supplements; or
- present health, medical or nutrition information or advice that is misleading or that you are not appropriately qualified or insured to provide.
Illegal content
In addition, you must not use the platform in any way that involves:
- the sale or distribution of stolen or illegal goods, or the proceeds of crime;
- fraud, financial crime or other dishonest activity;
- harassment, stalking, threats, abuse or hate-related offences;
- terrorism or the encouragement, preparation or instigation of terrorist acts;
- child sexual exploitation or abuse, including grooming or child sexual abuse material;
- encouraging or assisting suicide or serious self-harm;
- controlling or coercive behaviour or other forms of exploitation or abuse;
- the unlawful supply or promotion of drugs, psychoactive substances, firearms or other weapons;
- unlawful immigration activities or human trafficking;
- sexual exploitation of adults, extreme pornography or intimate image abuse; or
- any other criminal offence or unlawful activity.
Advertising and unsolicited communications
You must not use the platform, the messaging feature or any other interactive feature to upload, post or send unsolicited advertising or promotional material, or to promote external products, services or websites, unless we have expressly permitted it. For the avoidance of doubt, this does not prevent a Coach and their Client from communicating about, or sharing, the coaching services, plans or recommendations that form part of their coaching relationship.
Professional standards
If you are a Coach, you must ensure that any coaching, training, nutrition or health-related information, guidance or plans you provide through the platform:
- are within the scope of your qualifications, competence and experience;
- comply with any professional, regulatory or insurance requirements that apply to you; and
- do not claim to diagnose, treat or prevent medical conditions unless you are appropriately qualified and authorised to do so.
You must not represent yourself as holding any qualifications, certifications or professional status that you do not in fact hold.
Site misuse
You must not:
- overburden, interfere with or disrupt the integrity or performance of the platform or its underlying systems, networks or infrastructure, or attempt to do so;
- attempt to gain unauthorised access to the platform, the server on which the platform is stored, or any server, computer or database connected to the platform;
- use any automated system, including without limitation robots, spiders, scrapers or offline readers, to access the platform or to extract, harvest, collect or compile any data or content from the platform, whether for personal or commercial use;
- decompile, reverse-engineer, disassemble or otherwise attempt to derive the source code, underlying ideas, algorithms or structure of the platform or any software or technology forming part of it; or
- circumvent, disable or otherwise interfere with any security-related features of the platform, including features that prevent or restrict the use or copying of any content or that enforce limitations on the use of the platform.
Offending content
If you become aware of any content, communication or user on the platform that you reasonably believe breaches this policy, please inform us at support@1fit.com
Moderation and cooperation
We may investigate any suspected breach of this policy and take such action as we reasonably consider appropriate to protect our users, the platform or third parties. This may include restricting access to content or features while we carry out our investigation.
If we investigate any suspected breach of this policy, you must cooperate with us and provide any information we reasonably request in connection with that investigation.
Consequences of breaching this policy
Where we reasonably believe that you are in breach of this policy, we may take such action as we consider appropriate, including:
- suspending or terminating your access to the platform or any part of it;
- removing or disabling access to any User Content;
- suspending or terminating your account and, if you are a Coach, your subscription (in accordance with our Subscription Terms and Conditions); and/or
- reporting the breach to relevant law enforcement authorities and disclosing your identity to them where required or permitted by law.
